The Office of Community Living (OCL) is working on a variety of policy and rule changes related to its Home and Community Based Services waivers and programs. The engagement of clients and stakeholders throughout these changes is a critical part of this process. Below is information about a variety of projects.

Billing for Temporary 2.11% HCBS Rate Increase

The Department’s Medicaid Operations Division hosted a live webinar on June 1, 2022 to assist providers with billing the temporary 2.11% rate increase, which utilizes Home and Community-Based Services (HCBS) American Rescue Plan Act (ARPA) funding.

CLLI and SCI Waiver 2020 Renewal Stakeholder Engagement

The Department of Health Care Policy & Financing (the Department) is preparing to renew the following Home and Community-Based (HCBS) waivers in 2020:

Children with Life Limiting Illness (CLLI) waiver and Persons with Spinal Cord Injury (SCI) waiver

The formal public notice period for the CLLI & SCI waiver renewals will be in February 2020.

Department staff is identifying areas for language changes and developing the waiver application throughout the Fall of 2019.

The Department would like to invite all interested stakeholders to provide the Department with suggestions and feedback regarding the renewal of the CLLI and SCI waivers. Stakeholders can provide suggestions and feedback by:

Community Living Advisory Group

The Community Living Advisory Group considered and recommended changes to the long-term services and supports (LTSS) delivery system. The Advisory Group worked closely with the Colorado Commission on Aging and other planning groups to carry out this work and build on previous discussions and recommendations.

Per Executive Order D 2012-027, the Advisory Group worked from August 2012 to September 2014 developing recommendations for its Final Report. Information related to this report can also be found in the Department’s December 2015 Summary of Response to Legislative Request for Information.

HB18-1407: Stabilization of Direct Support Professional Workforce

Passed in 2018, House Bill (HB) 18-1407 requires the Department of Health Care Policy and Financing (the Department) to implement a 6.5% increase in the reimbursement rate for certain home and community-based services (HCBS) provided to individuals receiving services through the Developmental Disabilities, Supported Living Services, and Children's Extensive Supports waivers.

    Remote Supports Stakeholder Meetings

    Remote Supports New Provider Training - December 2021

    This meeting engaged providers, members, and all other stakeholders as the Department worked to implement the Remote Supports benefit. Per Senate Bill 21-210, the Remote Supports benefit was implemented on January 1, 2022 in the following Home and Community-Based Services (HCBS) adult waivers: Brain Injury; Elderly, Blind and Disabled; Community Mental Health Supports; Spinal Cord Injury; Supported Living Services.‬

      SB 19-238 - Improve Wages And Accountability for Home Care Workers

      Passed in 2019, Senate Bill (SB) 19-238 required the Department of Health Care Policy and Financing (the Department) to request an 8.1% increase to the reimbursement rate for personal care and homemaker services. The bill established parameters through which home care agencies must pass through rate increases to personal care workers and report compliance to the Department. The bill set an hourly minimum wage for personal care workers of $12.41 per hour effective July 1, 2020. Finally, the bill required the Department to work collaboratively with the Department of Public Health and Environment (DPHE) and stakeholders to establish a process for reviewing and enforcing initial and ongoing training requirements for persons who provide covered services.

      The Training Advisory Committee was appointed on October 1, 2019 and concluded work on December 31, 2019. The committee was charged with developing a report of its findings and recommendations by January 1, 2020.
