Background Information:  
The Colorado Department of Health Care Policy & Financing (Department) invites the public to comment on proposed waiver amendments to the following Home and Community-Based Services (HCBS) waivers: Persons with Brain Injury (BI), Children’s Extensive Supports (CES), Children’s Home and Community-Based Services (CHCBS), Children’s Habilitation Residential Program (CHRP), Children with Life-Limiting Illness (CLLI), Community Mental Health Supports (CMHS), Developmental Disabilities (DD), Elderly, Blind and Disabled (EBD), Persons with Spinal Cord Injury (SCI), and Supported Living Services (SLS). 

The Department intends to submit the amendments to the Centers for Medicare and Medicaid Services (CMS) on September 17, 2021. The Department will request an effective date of January 1, 2022 for the ten amendments. The proposed waiver amendments give the Department the ability to include the following changes:

  • Single Entry Point (SEP) appointments (BI, CLLI, CMHS, EBD, and SCI)
  • Update Case Manager Qualifications (CES, CHRP, DD, and SLS)
  • Transportation Services Update (BI, CMHS, EBD, SCI and SLS)
  • Waiver Enrollment Increase (DD)
  • Overall Spending Limit Exception Process (SLS)
  • Application of 2.5% across the board (ATB) rate increase to all waiver services excluding negotiated rate (BI, CES, CHRP, CHCBS, CLLI, CMHS, DD, EBD, SCI, and SLS)
  • Addition of Remote Supports to Service Definitions of Electronic Monitoring and Personal Emergency Response Systems (BI, CMHS, EBD, SCI, and SLS) 
  • Amend language for Authorized Representative in In-Home Support Services (IHSS) (CHCBS, EBD, and SCI)
  • Addition to Residential Habilitation Provider Type (DD)
  • Respite Update (CHRP)
  • Addition to Habilitation Provider Type (CHRP)
  • Consumer-Directed Attendant Support Services EVV Compliance Protocol (BI, CMHS, EBD, SCI, and SLS)
  • Update Appendix J to reflect changes to Supported Employment (DD and SLS)
  • Clarify Performance Measures language (BI, CMHS, DD, EBD, SCI, SLS)
     

The draft waiver amendments are available online for public comment starting August 12, 2021 through September 14, 2021, allowing all HCBS consumers and service providers an opportunity to provide input.  All comments will be reviewed and taken into consideration by the Department.  The Department will create a Listening Log to record the comments and the Department’s responses. This Listening Log will be posted to the HCPF website after the public comment period ends.

HCBS Settings - Final Settings Rule - Heightened Scrutiny Determinations

The Department has made determinations relating to settings subject to heightened scrutiny under the federal Home- and Community-Based Services (HCBS) Settings Final Rule.

The Department’s heightened scrutiny determinations are currently open for public comment. The 30-day public comment period runs from June 10, 2021 through July 10, 2021. The Department intends to submit the determinations to CMS after it has reviewed and addressed the comments received during the public comment period. CMS will make final determinations regarding these settings.

The Colorado Department of Health Care Policy & Financing (the Department) invites the public to comment on proposed waiver amendments to the following Home and Community-Based Services (HCBS) waivers: Persons with Brain Injury (BI), Community Mental Health Supports (CMHS), Developmental Disabilities (DD), Elderly, Blind and Disabled (EBD), Persons with Spinal Cord Injury (SCI), and Supported Living Services (SLS).  

The Department intends to submit the amendments to the Centers for Medicare and Medicaid Services (CMS) on December 14, 2020. The Department will request an effective date of March 10, 2021 for the six amendments. The proposed waiver amendments give the Department, if agreed upon with stakeholders, the ability to include the following changes: 

  • Update the Adult Day service definition to reflect a new three-tiered structure (CMHS, EBD, SCI)
  • Update the Adult Day service definition to reflect a new two-tiered service structure (BI)  
  • Update Day Habilitation service, Specialized Habilitation and Supported Community Connector to reflect a new three-tiered structure (DD, SLS) 
  • Update the Day Habilitation service, Specialized Habilitation and Supported Community Connector with an annual cap on spending (DD, SLS) 
  • Update corresponding budget projections for all six waivers based upon new Adult Day (BI, CMHS, EBD, SCI) and Day Habilitation, Specialized Habilitation and Supported Community Connector (DD, SLS) service tiered structure. 

The draft waiver amendments are available online for public comment starting November 12, 2020 through December 11, 2020allowing all HCBS consumers and service providers an opportunity to provide input.  All comments will be reviewed and taken into consideration by the Department.  The Department will create a “Listening Log” to record the comments and the Department’s responses.
