Please view the most updated copy of the Community First Choice Draft Rules listed above. This copy is formatted according to required standards set forth by the Secretary of State office. This format change is in preparation for the upcoming presentation at the Medical Services Board (MSB) on April 11, 2025.
This version includes:
- Recent technical edits suggested by HCPF staff and the Attorney General's office. These technical changes include citation and reference updates, minor grammar or wording changes, and a few section additions that require mention of and/or citation to Community First Choice.
- All previous edits recommended by stakeholders and agreed on by HCPF.
- All changes discussed and vetted through the CFC Council. No policy or operational changes have been made without stakeholder engagement.
- All stakeholder comments and HCPF responses are located in our updated Listening Log.
While reviewing the MSB Draft CFC Rule Revisions, you may see abridged sections or shortened lists of definitions in a few sections compared to copies we have previously posted. For example, in Section 8.7200 Case Management Agency Requirements, you will not see all the current rule definitions listed in that section. The sections omitted are not changing. Due to the length of that section and lack of changes, it is not included in the rule draft to be presented to MSB. This is a standard process when making rule changes and ushering those changes through our formal clearance process, as it assists reviewers with a more expedited review. If you would like to view current rule sections that are not being modified during this rulemaking process, please view current rule drafts on the Secretary of State Website.
Lastly, the MSB timeline for the CFC rule has not changed. The rule is going to MSB for Initial Adoption on April 11, 2025. The CFC rule will be brought to MSB for Rule Preview on March 14, 2025. HCPF will also hold a Public Rule Review meeting on March 24, 2025 for stakeholders and rule authors to connect, especially if they have not had the opportunity to do so ahead of time.

The Draft Wellness Education Benefit (WEB) Rule was approved by the Medical Services Board on February 14, 2025 and will be effective on March 30, 2025.

CFC Council Purpose
The Community First Choice (CFC) Council is in place to collaborate with and advise the Colorado Department of Health Care Policy and Financing (HCPF) on the design and implementation of a CFC option in Colorado. This option will improve access to home and community-based services. The CFC Council primarily consists of individuals with disabilities, those 65 years or older, and their representatives. The experience and expertise of the council will help ensure that CFC is implemented in a way that best meets the needs of Coloradoans with disabilities. To achieve this goal, the council will support HCPF by identifying key challenges, sharing insights, and finding solutions that best support the implementation and development of a sustainable CFC Option in Colorado.
The CFC Council is required by the Code of Federal Regulation 42 CFR 441.575. This requirement aligns with HCPF's philosophy that services and supports must be developed in partnership with those who utilize the services.
