Medicaid Grievance Timeframe Stakeholder Engagement

Concerning the complaints members can submit to their health plans about their experiences while receiving health care services. 

The Department invites you to provide feedback to help inform and refine proposed policy changes that will align the Medicaid grievance timeline with federal guidelines, clarify expectations around member involvement in Medicaid grievance resolution, and clarify processing, tracking and reporting practices.  

This proposed rule change will extend the timeline for resolving grievances filed by members from 15 working days to 90 calendar days, in alignment with federal regulations. The extended timeline will ensure that there is adequate time to review and resolve the grievance and preventing and addressing member safety concerns more completely.  The extended timeline will ensure adequate time to review and resolve the grievance, including comprehensive and timely review of member and safety concerns. The rule change will also clarify expectations regarding processing, tracking, reporting, and inclusion of members in the grievance process for Managed Care Entities (MCE).
